Identify the heirs and the estate before considering distribution. Debts, wills and earlier transactions matter alongside assets. An inheritance certificate is not itself a distribution.
What does the certificate establish?
An inheritance certificate helps establish heirship and shares. It is not an agreement assigning each asset to a particular person. Civil records, a will and other relevant legal circumstances may need separate examination.
Debts and rejection of inheritance
An estate includes more than property and bank accounts; liabilities must also be considered. Rejection of inheritance involves specific conditions, timing and conduct that may amount to acceptance. Clarify incomplete debt information before dealing with estate assets.
Distribution and co-ownership
An agreement to distribute, a claim to end co-ownership, reduction of dispositions and claims concerning a disguised transfer have different purposes. Mandatory mediation should be assessed for ending co-ownership. There is no single form of proceedings for every inheritance dispute.
Starting documents
Gather any inheritance certificate, property and account records, debt notices, will and earlier transfer documents. Record dates of death, knowledge, service and transactions. Where another country is involved, applicable law and the use of foreign documents require separate consideration.
