Determining rent and recovering possession are different claims. The lease dates, notices and requested outcome must be identified before choosing a procedure.
Identify the claim
Unpaid rent, rent assessment, personal need and an undertaking to vacate each involve different conditions. The start date, renewal periods, use of the property and payment history matter. Expiry of the stated term does not always entitle a landlord to possession.
Keep notices and proof of service
The contents and delivery dates of notices can affect available claims and their timing. Keep envelopes, service records and payment evidence together. A document’s heading or the presence of a signature alone does not establish its legal effect.
Consider mediation and its scope
Rental disputes may require mediation before court proceedings. The statutory exception concerning eviction through non-judicial enforcement must be considered separately. Court, enforcement and mediation procedures serve different functions; the nature of the claim determines the appropriate sequence.
Prepare the records
Gather the lease and annexes, payment records, notices and any original undertaking to vacate. Check the identity and authority of the parties. Changing locks or cutting services is not a substitute for a lawful process.
